EU New Battery Regulation (EU) 2023/1542

Concerning batteries and waste batteries, amending Directive 2008/98/EC and Regulation (EU) 2019/1020 and repealing Directive 2006/66/EC

EU New Battery Regulation (EU) 2023/1542 published by EU commission on 2023.07.28 and entered into force from 2023.08.17. The regulation has three objectives: strengthening the functioning of EU internal market (including products, processes, waste batteries and recycles), promoting a circular economy, and reducing environmental and social impacts throughout all stages of battery life cycle.

The Regulation lays down mandatory requirements for all batteries placed on the EU market (except for military, space, nuclear purposes). Those requirements cover sustainability and safety, labelling, marking and information, due diligence, waste battery management, battery passport, green public procurement etc. The regulation specifies obligations of the manufacturer, importer and distributor of batteries and products containing batteries, also establish conformity assessment procedure and market surveillance requirements. Manufacturers of cells, modules, battery packs, energy storage system, EV battery systems and end product shall pay high attention on the regulation.

  • Used for vehicle ignition, lighting, or starting purposes

  • Auxiliary or backup batteries for vehicles, other transport, or mechanical transport equipment

  • Abbreviated as SLI battery

Light means of transport battery (LMT battery)

  • Sealed
  • Weights below or equal to 25kg
  • Drives L-type vehicles
  • Not classified as electric vehicle batteries
  • Abbreviated as LMT battery

Industrial battery

  • Batteries designed for industrial use

  • Batteries intended for industrial uses after repurposing

  • Or other batteries weighing over 5 kg and not classified as LMT/SLI/EV batteries

Electric vehicle battery (EV battery)

  • Used for hybrid or battery electric vehicle traction

  • Used for L-type light vehicles, but with a weight greater than 25 kg

  • Abbreviated as EV battery

In terms of battery functionality, it includes rechargeable and non-rechargeable batteries; in terms of battery structural status, it includes cells, battery modules, and battery systems. Safety requirements are specified for stationary battery energy storage systems.

Furthermore, the new regulations impose requirements on battery design and performance, such as performance and durability requirements for general-purpose portable batteries; performance and durability requirements for rechargeable industrial batteries, LMT batteries, and electric vehicle batteries. The regulation also specifies requirements for the detachability and replaceability of portable batteries and LMT batteries.
